Welcome to Notary Smart Services. These terms and conditions ("Terms") govern your use of the website at nsmartva.com (the "Site") and your engagement of services from Notary Smart Services LLC ("Notary Smart," "we," "us," or "our"). By using the Site or engaging our services, you agree to these Terms.
1. Who we are — and who we are not
Notary Smart Services LLC provides notarial, process service, court filing, courier, and administrative support services in the Commonwealth of Virginia and, for certain services, nationwide. We are not a law firm and do not engage in the practice of law. Nothing on this Site or in our services constitutes legal advice, and no attorney-client relationship is created. Clients are responsible for the preparation and content of their legal documents, or may engage a licensed attorney.
2. Services and scope
- All services are performed as described in a written quote, booking confirmation, or service agreement.
- Notarial acts are performed in accordance with Virginia law, including verification of identity and willingness. We may decline any notarization that does not meet legal requirements.
- Process service is performed in accordance with applicable rules of the jurisdiction where service occurs, with documentation of attempts and outcomes. We do not guarantee that a particular individual will be successfully served.
- Courier and administrative services are performed as agreed in writing for each engagement.
3. Quotes, fees, and payment
- Fees are flat and quoted before work begins. Quotes are valid for 30 days unless stated otherwise.
- Notarial fees follow Virginia's statutory maximums. Travel fees, where applicable, are agreed in advance.
- Payment is due as stated on your quote or invoice. Online payments are processed securely by Stripe; we do not store your card details.
- Fees for work already performed (including attempted service documented in good faith) are non-refundable unless we agree otherwise in writing.
4. Scheduling, cancellation, and no-shows
- Appointments may be rescheduled or cancelled up to 24 hours in advance at no charge.
- Cancellations with less notice, or a failure to appear, may incur a fee reflecting time and travel already committed.
- If we must reschedule, we will notify you as early as possible and no fee applies.
5. Client responsibilities
- Provide accurate, complete, and lawful information and documents.
- For notarizations: present a valid, acceptable form of identification and sign willingly and knowingly.
- For process service and filings: provide correct names, addresses, deadlines, and properly prepared documents.
- Use our services only for lawful purposes.
6. Confidentiality
We handle your documents and information with discretion and care, limiting access to those who need it to perform the work. Our Privacy Policy describes how website information is collected and used.
7. Limitation of liability
To the fullest extent permitted by law, Notary Smart Services LLC's total liability for any claim arising out of our services or this Site is limited to the amount you paid us for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, or for outcomes of legal proceedings, court decisions, deadlines set by third parties, or delays caused by courts, agencies, weather, or other events beyond our reasonable control.
8. No guarantee of outcomes
We perform our services diligently and document our work, but we do not guarantee legal outcomes, court acceptance of any filing prepared by you or your attorney, or the success of service on any particular individual.
9. Website use
- Site content (text, graphics, and branding) belongs to Notary Smart Services LLC and may not be copied for commercial use without permission.
- The Site links to third-party tools (such as scheduling, forms, and payment pages). Those sites have their own terms and privacy practices.
- You agree not to misuse the Site, including attempting to disrupt it or submitting false or malicious information through our forms.
10. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts serving Portsmouth, Virginia.
11. Changes to these Terms
We may update these Terms from time to time. The "Effective" date above shows when they were last revised. Continued use of the Site or our services after changes means you accept the updated Terms.
